Talk about pushing your luck, a prison inmate, named Patrick Makhala who is currently serving a four year sentence in Botswana for stealing a car is demanding that he be released on bail to face trail in another case where is he accused of being in possession of another stolen vehicle.
The lawyer for convict, Thato Mujaji, told the senior magistrate, that though he is a convict, this does not totally strip him of his bail rights.
"It does not mean he is not entitled to bail. This is a long standing matter of 2006 and if the trial does not take off on July 28, we will have to consider bail," Mujaji said. He sought bail saying that his client qualifies for extra mural punishment since he has already spent some time in jail.
The prisoner argued that if he is granted bail in the pending matter, it will be an advantage for him because he will qualify for a presidential remission of his current sentence. The state persecutors raised their objections to the claim saying that extra-mural punishment is not earned by right.
They also argued that Makhala is a convict and a serving prisoner and thus was not entitled to bail arguing that the applicant will be prejudiced if he is not granted bail.
